Delhi HC suspends jail term of former BJP leader Kuldeep Sengar in Unnao rape case

The Delhi High Court has suspended the jail term of former Bharatiya Janata Party (BJP) leader Kuldeep Sengar, who was convicted in connection with the 2017 Unnao rape case. The court’s decision, delivered on October 27, 2023, allows Sengar to remain free while his appeal against the conviction is pending.

Kuldeep Sengar was sentenced to life imprisonment in December 2019 for the rape of a minor girl in Unnao, Uttar Pradesh. The case garnered national attention due to the political connections of Sengar and the subsequent events surrounding the victim and her family, including a tragic car accident that killed two of her aunts. The victim’s case highlighted issues of sexual violence, political influence, and the challenges faced by survivors in seeking justice in India.

The Delhi High Court’s ruling came after Sengar’s legal team argued that the trial court had erred in its judgment and that the evidence presented was insufficient to warrant a life sentence. Subsequently, the Supreme Court ordered the Central Bureau of Investigation (CBI) to take over the investigation.

The case took a tragic turn in July 2019 when the victim and her family were involved in a car accident that resulted in the deaths of two of her aunts. The incident raised suspicions of foul play, and the CBI launched a separate investigation into the accident. The victim survived the crash and continued to advocate for justice, becoming a symbol of resilience for many survivors of sexual violence in India.

In December 2019, a special court convicted Sengar of rape and sentenced him to life imprisonment. The court found that Sengar had exploited his position of power to commit the crime and had attempted to intimidate the victim and her family. The conviction was seen as a significant step in addressing the issue of sexual violence against women in India, particularly in cases involving influential individuals.

The suspension of Sengar’s sentence has raised concerns among women’s rights activists and legal experts, who fear that it may undermine the progress made in the fight against sexual violence.
